Terms of Service

1. Parties & Acceptance
These Terms of Service (“Terms”) govern the purchase and use of services provided by Black Software Marketing 19 OÜ (“Serverlon”, “we”, “us”) via serverlon.pro to any customer (“Customer”, “you”). By creating an account, starting a 24-hour free trial, purchasing a service, or otherwise using our services, you agree to these Terms and all referenced policies.
2. Services

Server, hosting and VPS Services: Hosting, virtual and/or dedicated servers and related features (e.g., bandwidth, storage, IPs). Some plans include a 24-hour free trial (“Trial”).

Domain Services: domain registration, transfer, renewal, DNS management, and WHOIS privacy (where available). Minimum contract terms: 12 or 24 months depending on TLD and offer.

Support: standard support via email (info@serverlon.pro).

Add-ons: backups, snapshots, extra IPs, monitoring, etc., if offered.
We may modify, enhance, or discontinue features with reasonable notice when required.
3. Account, Eligibility & Verification

You must be at least 18 and have legal capacity to contract.

You agree to provide accurate information and keep it up to date.

We may require KYC/verification (e.g., identity or company documents) to prevent fraud or abuse.

You are responsible for safeguarding your credentials and any activities under your account.
4. Order Process & Activation
-
Orders are placed online. Acceptance by the customer is automatic upon placing the order, with no additional steps required. The customer must send an email to info@serverlon.pro to associate their domain with the hosting. Failure to send the email to associate the domain with the hosting does NOT mean that the service fee will not be charged, as the service has already been activated and associated with the customer.

Server Trial: Trial begins at activation and ends automatically after 24 hours. Unless cancelled within the Trial (see Section 6), the selected paid plan auto-activates and auto-charges at the posted price.

Domains: Once submitted and paid (or verified if required), we attempt registration/transfer with the relevant registry/registrar. Successful registrations are final and non-refundable (see Refunds).

Shared Hosting Services:
For shared hosting plans, the Customer must send an email to info@serverlon.pro requesting the personalized access credentials. The email must include:-
The domain name to be used for the hosting account, so that we can configure the service accordingly.
The service is considered active from the moment of activation on our systems, even if the Customer does not send the email with the domain name. The Customer’s failure to provide the required domain information does not exempt them from payment obligations, as the subscription and resources are provisioned and allocated from the moment of activation.
The domain name is required solely to associate the hosting account to the Customer’s chosen domain; however, the technical service will remain active and billable regardless of whether the domain is linked.

5. Term & Renewal

Servers (monthly): month-to-month unless otherwise stated. Auto-renews unless cancelled before the renewal deadline (see Section 6).

Domains: minimum term 12 or 24 months as stated on the product page. Auto-renews for the same period unless you disable auto-renew at least 15 days before expiration (or earlier if required by the specific TLD rules).

You are responsible for ensuring timely renewal and payment to avoid service interruption or domain loss.
6. Cancellation

Trial (Servers): You can cancel any time within the 24-hour Trial via your account or by emailing info@serverlon.pro with your service ID. If you do not cancel within the Trial, billing commences per the selected plan.

Servers (paid): Cancel at least 5 days before your renewal date to avoid next charge. No pro-rata refunds for partial months already started.

Domains: You may disable auto-renew, but early cancellation does not entitle you to a refund. Once registered, domains are non-refundable except where mandatory law or specific registry policy requires otherwise.

For shared hosting services, cancellation requests are subject to the same notice periods as other services. Not providing the required domain information does not constitute a valid cancellation request. The Customer must provide the required domain information by emailing info@serverlon.pro so we can configure the hosting account.
If the Customer does not send this information, the service will still be considered active from the moment of activation in our systems and will remain billable.
Not sending the domain information does not mean the service is cancelled. To stop future charges, the Customer must submit a formal cancellation request following the same notice period and procedure as for any other service (see Section 6: Cancellation).
7. Pricing, Billing & Taxes

Prices are shown in EUR and may include or exclude VAT depending on your location and VAT status.

We may update prices; changes apply from the next renewal and will be communicated with reasonable notice where required.

You authorize us to charge your saved payment method for renewals, add-ons, overages, and applicable taxes.

Chargebacks/Disputes: opening an unjustified chargeback may lead to immediate suspension and fees to cover investigation and network/processor penalties.
8. Acceptable Use & Prohibited Conduct
You must comply with our Acceptable Use Policy (AUP). Prohibited activities include, without limitation: spam, phishing, malware, illegal content, intellectual property infringement, DDoS, unauthorized scanning, crypto-mining not expressly allowed, child sexual abuse material, and any activity violating laws or third-party rights. Breach may result in immediate suspension/termination without refund and reporting to authorities.
9. Domains – Special Terms

Registrations are subject to each registry/registrar policy (e.g., ICANN or ccTLD policies). By ordering, you agree to those policies.

Incorrect or incomplete WHOIS data may lead to suspension or deletion by the registry/registrar.

Transfers may have specific locks, codes (EPP/Auth), and timing windows.
-
We are not responsible for failed registrations or renewals caused by your delay, non-payment, or policy breaches.
10. Data, Backups & Retention

You are responsible for backing up your data unless you purchase a backup add-on.

Upon termination, we may delete data after 3 days (or earlier if required by law or abuse handling).

We are not liable for data loss unless otherwise required by mandatory law.
11. Service Levels
We target an uptime of [[99.9%]] per calendar month for network and power availability on our side. Scheduled maintenance windows and factors beyond our control are excluded. See the Service Level Agreement (SLA) for details and credits.
12. Beta/Trial Features
Trial or beta features are provided “as is” without warranties and may be withdrawn at any time.
13. Warranties & Disclaimers
Services are provided “as is” and “as available”. We disclaim implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
14. Liability
To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, or data; and
-
Our aggregate liability for all claims in any 12-month period is limited to the fees you paid for the affected service during that period.
15. Indemnity
You agree to indemnify and hold us harmless from claims arising from your content, breach of these Terms or AUP, or violation of law or third-party rights.
16. Consumer Withdrawal (EU/EEA)
By ordering digital services for immediate performance, you expressly request immediate performance and acknowledge loss of the 14-day withdrawal right once service starts (see Refunds and Privacy Policy for details).

17. Privacy & Cookies
Processing of personal data is described in our Privacy Policy and Cookie Policy. A Data Processing Addendum (DPA) is available where we act as processor.
18. Changes
We may update these Terms. Material changes will be notified (e.g., email or dashboard). Continued use after the effective date constitutes acceptance.
19. Governing Law & Disputes
These Terms are governed by Estonian law. Exclusive jurisdiction: courts of Tallinn, Estonia, unless mandatory consumer venue rules apply.
Acceptable Use Policy (AUP)

To protect our network, customers, and the broader internet, you must not use our services to:

Abuse & Security: DDoS, botnets, port-scanning, brute-force, exploit attempts, or hosting command-and-control infrastructure.

Spam & Messaging Abuse: UCE/UBE, snowshoe spam, email list abuse, or using open relays.

Malware & Fraud: Distribution of malware, ransomware, keyloggers, phishing kits, crypto-jackers, or any deceptive schemes.
-
Illegal Content/Conduct: Anything unlawful in Estonia or the relevant jurisdiction (including CSAM, terrorist content, counterfeit, or unlawful porn).

IP Infringement: Hosting or distributing content that infringes copyright, trademark, or other IP rights.

Resource Misuse: Activities that unduly burden or degrade our platform (including unauthorized cryptocurrency mining) unless explicitly allowed in your plan.

Network Interference: Traffic manipulation, route hijacking, or attempts to evade abuse detection.

Privacy Violations: Unlawful tracking, scraping of personal data, or storing personal data without a lawful basis.
Enforcement
We may suspend or terminate services immediately and without refund upon AUP breach. Severe cases may be reported to authorities and/or relevant registries. Repeated abuse can result in permanent bans.

Report abuse to info@serverlon.pro with relevant logs/headers/URLs.
Service Level Agreement (SLA)

1. Scope
This SLA applies to production Server Services purchased from Serverlon. It does not apply to Trials, beta features, free tiers, or Domain Services.
2. Uptime Target
Monthly network and power availability target: [[99.9%]].
Exclusions: (a) scheduled maintenance announced ≥24h in advance, (b) customer-caused outages or code/app issues, (c) force majeure, (d) upstream carrier or registry failures outside our reasonable control, (e) DDoS and abuse mitigation actions, (f) law enforcement actions, (g) Trials/beta features.
3. Credits
If monthly availability falls below the target, you may request a service credit within 15 days after the month ends:

99.0%–99.9%: 10% of the monthly fee for the affected instance

95.0%–98.99%: 25%

<95.0%: 50%
Credits are not refunds, non-transferable, and capped at the monthly fee of the affected instance.
4. Measurement
Availability is measured by our monitoring at the data center edge. Partial unavailability of customer applications is excluded if our network and power are up.
Billing, Payments, Cancellation & Refunds Policy

1. Payments

Accepted methods: cards and other methods shown at checkout.

You authorize automatic charges for renewals and add-ons unless you cancel per deadlines below.

Prices may change on renewal with prior notice where required.
2. Taxes & Invoices

VAT will be applied based on applicable rules. Provide valid VAT details (if any).

Invoices are issued electronically via your account email.
3. Cancellation Deadlines
-
Server Trial: cancel within 24 hours from activation to avoid charges.
-
Paid Servers: cancel ≥5 days before the renewal date.
-
Domains: disable auto-renew ≥15 days before expiration (or earlier if required by TLD).
4. Refunds
-
Trials: free during 24 hours. If not cancelled, the first billing cycle is non-refundable once started.
-
Servers (paid): no pro-rata refunds for partial periods already in progress.
-
Domains: no refunds after successful registration/transfer/renewal, except where mandatory law or specific registry policy allows.

Abuse/Chargebacks: if you breach the AUP or file an unjustified chargeback, we may suspend/terminate without refund.
5. Chargebacks & Disputes
Contact info@serverlon.pro first. Unwarranted chargebacks may incur investigation/processor fees and lead to termination.
6. Data Retention After Cancellation
We may retain your server data for up to 7 days after termination for recovery requests (not guaranteed). Domain data persists per registry rules. Backups are only kept if you have an active backup add-on.
